Episode 42 Review | The Executive branches’ failure to abide by the constitution

Here is the spot to begin the episode 42 discussion.

Episode 42 was the first episode recorded in the new year, and boy was it a long one. Now holding the record for The Whole Magazine as the longest podcast in the shows’ history, episode 42 saw the crew talk about some very pressing matters as well as dive deep into some light-hearted and ultimately sentimental topics. Here are the major takeaways which need more discussion.

Joe Biden’s federal agents’ interference at the Texas border

New media outlets are repeatedly parroting an idiotic story of Texas officials abusing loopholes in order to, and get this, protect their borders from the massive illegal immigrant invasion that has been taking place since Biden took office.

The National Guard and volunteers are now along the border erecting more fencing and barriers to control the ceaseless flow of illegal immigrants across the southern border, something that the federal government has outright failed and refused to uphold according to the constitution.

“The United States shall guarantee to every State in this Union a Republican form of Government, and shall protect each of them against Invasion…”

Article IV, Section 4

There is also a clause in the U.S. Constitution that applies in this case. Article II, Section 4 says that “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

It is arguable that the Biden administration having failed and not only that, willfully and intentionally failing to uphold their duties would fall under the high Crimes and Misdemeanors.

Many rightfully have argued that the situation along the southern border is exactly that, an invasion. The estimated influx of illegal immigrants in the United States went from 15.5 million in 2022 to 16.8 million in 2023.

The monthly border crossing has not fallen below the 100,000 mark since January 2023.

Governor Abbot gave a statement on January 24th, 2024.

The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now. President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary.

Gov. Abbot has declared invasion under Article 1, Sec 10, Clause 3. The national guard, Texas Department of Public Safety and other Texas personnel are currently working to secure the Texas border.

The reason this is happening, is simple. It’s the same old story since time immemorial. The democrats will flood the country with a voter base. Illegal immigrants are far more likely to vote for a candidate that promises them free money and free benefits, so long as they go to the ballot box and make sure they get into office.

This just so happens to be the most egregious act of the federal government, using such blatant abuse of power as well as willful disregard of their constitutional duties to get such ends. Only when Gov. Abbot starting sending bus loads of the illegal immigrants over to democratic states did they start changing their tune. Crime rates are soaring in southern Texas communities as illegal immigrants flood in, damaging communities with crime and drugs.
